FTXユーザー集団訴訟　顧客資金返還の優先権を求める

FTXとアラメダリサーチに対する集団訴訟

FTXユーザーのグループは27日、米デラウェア州の破産裁判所に訴状を提出。FTXやアラメダリサーチに対して集団訴訟を起こした。顧客資金を優先して返還することや損害賠償を求めている。

原告側は、FTXからアラメダリサーチへの「違法な」送金は、「FTXの顧客同意事項や利用規約、さらに一般法と誠実・公正な取引の基本原則に違反している」と述べた。

また、損害を受けた顧客への返済を優先すべきだとして次のように申し立てている。

特に、アラメダリサーチに横流しされたFTXグループの顧客資産や、顧客の資産として特定可能な、その他の不正流用された現金や資産については、FTXユーザー以外の債権者へ分配が見込まれる財産の範囲には入らないと訴えた。

また、米国版FTXや、FTXのサム・バンクマン＝フリード前CEOら被告から、契約違反、受託者責任違反、横領などで損害賠償を受ける権利があるとしている。

アラメダリサーチや、その前CEOであるキャロライン・エリソン氏に対しても、受託者責任違反および横領の幇助に対する損害賠償を要求する形だ。額に関しては、裁判で決定されるものとした。

不正行為を指摘

訴状は、FTXグループが破産申請した後に、最大約2,700億円（20億ドル）の顧客資金が行方不明になっていることが発覚したが、これはFTX幹部がアラメダリサーチに顧客資金を横流ししたことが原因だったと指摘している。

その他にも、2022年に仮想通貨市場が低迷した際、FTXが損失を補填するため、数百の仮想通貨関連ベンチャー投資を行ったこと、アラメダリサーチの融資により、バハマでFTX幹部のための不動産購入に約334億円（2億5,000万ドル）以上を費やしていたことなどを挙げた。

その他の状況

顧客資産流用とは別に、FTXが破産申請を行った直後、同取引所にハッキング攻撃があり、約530億円にのぼる仮想通貨が流出したと見積もられている。

米司法省は、この流出資産について調査を開始したところだ。内部犯行の可能性もあり、サム前CEOは11月、容疑者は8人ほどに絞れたと話した。犯人はFTXの元社員か、元社員のコンピュータにマルウェアを仕込んだ人物のどちらかだと予測している。

なお、サム氏は米捜査当局から電信詐欺、商品詐欺の共謀、証券詐欺、マネロン、連邦選挙委員会を欺いて選挙資金違反を行った共謀などで起訴されている。民事では米証券取引委員会（SEC）からも提訴されている形だ。

サム氏は、滞在していたバハマ当局から米国に身柄を引き渡されており、現在は両親の家で当局の監視下に置かれている。

FTX前CEOサム氏、330億円で保釈

日本版FTXは26日に、顧客資産の管理状況について報告した。「暗号資産は当社のコールドウォレットにおいて、法定通貨は日本の信託口座において、分別管理を行っている」と改めて強調し、資産の額を公開している。
