FTXサム前CEOの罪状認否
FTXのサム・バンクマン＝フリード前CEOの罪状認否が、1月3日に米ニューヨーク州南部地区連邦地裁で行われることが、28日付けの裁判所資料で明らかになった。
バンクマン＝フリード被告は、米司法省から詐欺、マネロン、選挙資金提供の容疑で起訴されている。連邦捜査局（FBI）からは、電信詐欺、電信詐欺の共謀、商品詐欺の共謀、証券詐欺、マネロン、連邦選挙委員会を欺いて選挙資金違反を行った共謀で起訴されている。
主な容疑は、FTXに預けられた数十億ドルの顧客資産を不正流用し、FTXおよびグループ企業アラメダリサーチの投資家らを欺いたという行為によるものとされる。
罪状認否では、刑事裁判において被告人が起訴状にある公訴事実を認めるかどうかについて答弁を行なうこととなる。8つすべての訴因で有罪判決を受けた場合、最大115年の禁固刑が科される可能性があるが、それぞれの容疑で最大刑期が蓄積される事はないとの見方も出ている。
また、刑事告訴とは別に、米証券取引委員会（SEC）もバンクマン＝フリード氏を投資家への詐欺と顧客資産流用の容疑で提訴している。
バンクマン＝フリード被告はバハマ王立警察に逮捕され、今月12日にバハマから米国に身柄を引き渡された。22日には約330億円（2億5千万ドル）の保釈金で釈放。現在はカリフォルニア州の両親の家で厳しい監視下に置かれており、パスポートは廃止され、足首には追跡装置も装着されている。
アラメダ前CEOら
21日には、FTXの共同設立者ゲイリー・ワン被告と、姉妹企業Alameda Researchの前CEOキャロライン・エリソン被告が刑事責任を認めたことが明らかになった。
裁判所資料によると、エリソン被告は「FTX顧客に対する電信詐欺」「アラメダリサーチ貸金業者に対する電信詐欺」「商品取引・証券取引詐欺の共謀」「マネロン目的の詐欺」など、7件の起訴内容を認めた。ワン被告は4件の起訴内容を認めている。
エリソン被告の罪状は最大110年の懲役刑にも及ぶものだが、米司法省との司法取引により一部が罷免となる可能性がある。
21日に公開された司法取引の合意書によると、エリソンが連邦捜査局、および他の法執行機関に全面的に協力することを条件に、電信および商品詐欺罪に関する刑事税法違反を除く、刑事訴追を免れるという。
司法取引が有効になるには裁判所の承認が必要とされ、他の機関がエリソン氏に対して今後立件する可能性も排除されていない。また、エリソン氏の保釈には、約3,300万円（25万ドル）の保釈金と、旅行制限、渡航書類の引き渡しなどが求められている。
破綻した暗号資産（仮想通貨）取引所FTX、及び姉妹会社であるアラメダリサーチの杜撰な管理体制と、詐欺行為がますます明らかになっている。
13日には、FTXに対する米議会による公聴会が開催され、現CEOのジョン・J・レイIII氏が証言を行った。その中で、FTXの顧客資産がアラメダリサーチのトレーディング用途として流用されたこと、15億ドルを超える融資や支払いが内部関係者に対して行われたことなどを明かしていた。
